Boudin led a discussion on criminal justice issues at the “Justice Unveiled: Debating Crime and Public Safety Conference.”

Former prosecutor Cully Stimson took issue with the “progressive prosecutor” movement, saying, “There is nothing progressive about the progressive prosecutor movement, at least as you define the word 'progressive'.”

Stimson suggested that the movement is dangerous because it focuses solely on criminal defendants and does nothing to increase public safety or protect victims.

Stimson pressed the district attorneys on the panel about their philosophy, saying, “The offender-oriented approach to prosecution is based on the unstated and therefore unproven assumption that perpetrators of crime stand on the same moral level as their victims.”

Stimson then explained that protecting the vast majority of the community who do not commit crimes is a cornerstone of the social contract.

He asked, “How do you, in your role as (district attorney), uphold your end of the social contract?”

“This is a decision we've made that sets us apart from every other civilized country in the world,” Boudin said. “It's a policy choice, and it really doesn't have to do with security as much as it has to do with the history of racism in this country and a desire for retribution.”

Although he suggested that the progressive prosecutor movement is not about putting defendants above victims, he said that the Constitution creates rights for criminal defendants, but it “does not create rights for victims of crime.”

Furthermore, he said that prosecutors are not asked to represent victims of crime, but rather “all people in our jurisdiction” and that focusing on victims “disregards” the Constitution. Is.
